Landlord entry & access

No Texas statute sets a notice period for landlord entry — the lease controls. Out-of-state forms often recite a “24-hour rule” as if Texas required it; it doesn’t, but if your lease promises 24 hours’ notice, you are bound by that promise.

What Texas does regulate is lockouts and self-help. A landlord may change the locks for unpaid rent only if the right is in the lease and after advance written notice (5 days by mail or 3 days by hand-delivery or inside-door posting), and must hand over a new key at any hour whether or not the rent is paid (§92.0081). Interrupting a tenant’s utility service is separately restricted (§92.008).

Required disclosures in Texas

Applicants must also be offered the landlord’s written tenant-selection criteria when they receive an application; if the criteria weren’t made available and the applicant is rejected, the application fee must be refunded (§92.3515).

  • Owner & manager identity — The name and address of the record title holder and any off-site management company; including it in the lease satisfies the duty (§92.201).
  • Floodplain notice — Every lease of 30 days or more needs the statutory notice stating whether the landlord is aware the dwelling is in a 100-year floodplain, plus a second notice if the landlord knows it flooded in the past five years. For leases entered into or renewed from September 1, 2025, it may sit in a lease paragraph, an addendum, or a separate document given at or before signing, and both parties must sign it (§92.0135, SB 2349).
  • Repair remedies — The lease must describe the tenant’s repair and repair-and-deduct remedies in underlined or bold print (§92.056(g)).
  • Parking & towing rules — In a multiunit complex, any towing or parking rules must be given to the tenant before signing; if they’re in the lease or an attachment, the paragraph must be titled “Parking” or “Parking Rules” in capitals, bold, or underline (§92.0131).
  • Emergency phone number — Tenants must be given a number for reporting emergencies affecting health or safety (§92.020).
  • Copy of the lease — A complete copy must go to at least one tenant within three business days of signing (§92.024).
  • Lead-based paint — Federal warning, pamphlet, and known-hazard disclosure for housing built before 1978 (42 U.S.C. §4852d).
