Texas Military Clause (SCRA)

Ending a Texas tenancy

A fixed-term lease simply ends on its end date unless the lease requires notice. A periodic tenancy ends on the later of the date in the notice or one full rent period after notice is given — unless both parties signed an agreement setting a different period (§91.001).

  • SB 38 (suits filed from January 1, 2026) — If the tenant wasn’t late before the month the notice is given, a nonpayment notice must be a notice to pay rent or vacate; for a tenant with prior late payments it may be either form. The notice must go by mail, delivery to a conspicuous place inside the premises, hand delivery to a tenant 16 or older, or — only if agreed in writing — email or other electronic means (§24.005(a), (f-3)).
  • Family violence — A tenant with a qualifying protective order or documentation may end the lease on 30 days’ written notice and avoid future rent (§92.016).
  • Sexual assault & stalking — A victim of certain sexual offenses, or of stalking on the premises, within the preceding six months (or the victim’s parent or guardian living with them) may end the lease on 30 days’ written notice with the required documentation (§92.0161).
  • Military — A servicemember who enters service or receives PCS or 90-day-plus deployment orders may terminate; for monthly leases it takes effect 30 days after the next rent due date (§92.017).
  • Required warning — The lease must say, substantially, “Tenants may have special statutory rights to terminate the lease early in certain situations involving family violence or a military deployment or transfer” — and a similar statement for certain sexual offenses or stalking. Without them, a terminating tenant is also released from past-due rent (§§92.016(f), 92.0161(g), 92.017(g)).

At least one month from either side; the tenancy ends on the later of the date in the notice or one month after it’s given. The parties can agree in a signed lease to a different notice period (§91.001).
